This Creator Commission Revenue Share Agreement (the "Agreement") governs the terms and conditions of participation in the Evershop platform by creators (hereinafter referred to as "Creators"). By accessing or using the Evershop platform, Creators agree to abide by the terms and conditions set forth in this Agreement.
1. Revenue Share:
1.1 Creators shall be entitled to receive a commission equal to 50% of the net revenue earned by Evershop from e-commerce transactions generated through the Creator's shared content on the Evershop platform.
2. Payment:
2.1 Payment to Creators shall be made on a monthly basis, with the first payment scheduled after the end of each calendar month.
3. Content Ownership and Responsibility:
3.1 Creators acknowledge that they retain ownership of all content created and shared on the Evershop platform.
3.2 Creators shall ensure that all content shared complies with relevant laws, regulations, and does not infringe upon any third-party intellectual property rights.
3.3 Creators shall indemnify Evershop against any claims arising from the content’s infringement of third-party rights.
4. Term and Termination:
4.1 This Agreement shall remain in effect until terminated by either party.
5. Governing Law and Jurisdiction:
5.1 This Agreement shall be governed by and construed in accordance with the laws of [Dubai, United Arab Emirates].
5.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
6. Entire Agreement:
6.1 This Agreement constitutes the entire agreement between Creators and Evershop concerning the subject matter hereof and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.
By accessing or using the Evershop platform, Creators acknowledge they have fully read, understood, and agree to the terms and conditions set forth in this Agreement.
